General Terms and Conditions of the 2027 Swiss Folk Music Festival (GTC)

1. General Provisions

  • The 2027 Swiss Folk Music Festival is an event organized by the Association for the 2027 Swiss Folk Music Festival in Altstätten, hereinafter referred to as the “Organizer” or “EVMF.”
  • A contractual relationship is established upon the purchase of a ticket and exists exclusively between the purchaser and ticket holder and the event organizer. By purchasing a ticket, the purchaser and ticket holder accept the event organizer’s terms and conditions.
  • The organizer may use the purchaser’s personal information for its own communication purposes (newsletters, etc.). You may unsubscribe at any time. Personal information will only be shared to the extent necessary for contract fulfillment, the operation of the event, or to comply with legal obligations.
  • The following General Terms and Conditions apply to visitors and all contractual partners of the organizer.
  • You must follow the instructions of the event organizer's staff.

2. Program

2.1 Music Program

The organizer reserves the right to change the program without prior notice. The organizer assumes no liability whatsoever with regard to the format, duration, or content of the concerts.

2.2 Photographs, Audio Recordings, Film Recordings, and Video Recordings

Event attendees are advised that the audience may take photographs, make audio recordings, and shoot video before, during, and after the event, and that these recordings may be used and exploited commercially—including, in particular, for live broadcasts—by the organizer or third parties without compensation. By attending the event, attendees acknowledge that photographs, audio recordings, and video recordings may be made and used for communication and documentation purposes.

3. Access to the festival village and the concerts

3.1 Safety

  • The organizer’s security staff will conduct security and admission checks at all official entrances and throughout the festival grounds for the entire duration of the event. You must comply with the instructions of the security staff.
  • The security staff employed by the event organizer has the right to A) deny an event attendee admission to the event without compensation or B) remove an event attendee from the event during the event without compensation if the attendee fails to meet the admission requirements, in particular those resulting from official requirements, or if the event attendee fails to comply with the organizer’s safety and/or operational regulations despite being requested to do so by ZU or its agents. The exclusion may apply to a single event or to the entire EVMF.
  • Bringing glassware, pyrotechnic devices, and weapons of any kind is generally prohibited. Failure to comply will result in removal from the festival grounds. The organizer expressly reserves the right to take further legal action.
  • The organizer reserves the right to enforce its rules throughout the entire festival grounds.

3.2 Admission

  • By purchasing a ticket, you are granted a revocable right to attend the event.
  • Tickets will be checked at the official entrances to the lecture venues and, if necessary, exchanged for a wristband. A ticket for the gala evening guarantees admission to the respective venues under the conditions specified in Section 3.1. For all venues and events accessible with the 3-day pass, admission is not guaranteed and is subject to available capacity.
  • You must strictly comply with the instructions of security personnel.
  • Lost or damaged tickets will not be replaced.

3.3 Right to a Refund

  • Returns, exchanges, and refunds of tickets are generally not permitted.
  • The organizer shall not be liable for any damages incurred by customers as a result of cancellations due to force majeure. Force majeure includes, in particular, natural disasters, pandemics, epidemics, government orders, terrorist acts, strikes, acts of war, technical failures, or other events beyond the organizer’s control.

3.4 Transferring Tickets

  • Tickets may be transferred to others for personal use. Commercial resale without the organizer's consent is prohibited.

4. Data Protection

  • The organizer may store and process the purchaser’s data collected during ticket sales and use, and may use such data for its own communication purposes. Personal data will be disclosed only to the extent necessary for contract fulfillment, the operation of the event, the use of service providers, or to comply with legal obligations. The customer hereby agrees to this.
  • The organizer agrees to delete any personal data collected during the admission registration process in accordance with official requirements after 14 days.
  • By purchasing tickets, you confirm that you have read and understood the privacy policy.

5. Liability

  • Liability for slight negligence is excluded to the extent permitted by law. This does not apply to cases of willful misconduct, gross negligence, or mandatory statutory liability. To the extent permitted by law, the organizer is not liable for damages caused to visitors or exhibitors by third parties.
  • The organizer is not responsible for lost or stolen items. Lost and found items will be turned over to the police station in Altstätten in accordance with the EVMF.
  • Legal guardians are responsible for minors.

6. Damages

  • Claims for damages arising from positive breach of contract, fault in the conclusion of the contract, and tort are excluded, unless the organizer, its legal or statutory representative, or its agents acted with intent or gross negligence. Claims for damages arising from impossibility of performance and delay are limited to compensation for foreseeable damages in cases of slight negligence.

7. Payment Terms

  • The organizer generally adheres to a 60-day payment term.
  • Advance payments will be made as contractually agreed.

8. Final Provisions / Jurisdiction

  • Any changes to these General Terms and Conditions must be made in writing.
  • No side agreements will be made.
  • The organizer reserves the right to amend these general terms and conditions at any time.
  • The General Terms and Conditions of Contract are considered an integral part of all contracts relating to Swiss folk music.
  • Altstätten SG is agreed upon as the venue for legal proceedings and the place of performance for all disputes arising from these General Terms and Conditions.
